These Terms & Conditions ("Terms") govern your use of the website, online booking, in-salon billing, and customer mobile/web application ("Customer App") of Elite Elegance Studio ("we", "us", "the Salon"). These digital services are powered by the ESA (Elite Salon Alliance) technology platform, operated by Elite Salon Alliance ("ESA"), which provides the website, point-of-sale (POS), marketing, and customer app infrastructure on our behalf. By booking a service, making a purchase, or using the Customer App, you agree to these Terms.
By accessing our website, booking an appointment, availing a service at our salon, or registering on the Customer App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website, app, or services.
We offer beauty and grooming services at our physical salon location(s). To support these services, we provide:
A website where you can view our services, offers, and book appointments.
An in-salon point-of-sale (POS) system for billing and generating receipts.
A marketing module through which we may send you offers, reminders, and promotional communications.
A Customer App through which you can view digital billing receipts, track prepaid packages, and view/redeem coupons and offers.
These digital tools are technology infrastructure provided by ESA. ESA is not itself the provider of beauty or grooming services — all services are rendered by the Salon, and the Salon is solely responsible for service quality, safety, and outcomes.
This clause defines the legal boundary between the Salon and the Platform. Please read it carefully.
ESA (operating as "Elite Salon Alliance" / "Elite Alliance") is solely a technology and infrastructure provider. It builds and maintains the website, POS billing software, marketing/campaign tools, and Customer App used by the Salon. ESA does not employ the Salon's stylists or staff, does not set service prices, does not perform, supervise, or guarantee any beauty, grooming, wellness, or salon service, and does not take possession of goods or products used in such services.
The Salon is the sole service provider and contracting party for every service you book or receive. Your contract for beauty/grooming services, and every obligation arising from it (service quality, hygiene, safety, staff conduct, pricing, refunds, cancellations, package terms, and outcomes) is between you and the Salon alone. ESA is not a party to that contract.
ESA acts as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000, providing the technology by which the Salon offers bookings, billing, and loyalty/offer management. ESA does not select, initiate, modify, or exercise editorial control over the content, pricing, offers, or service commitments the Salon publishes or issues to you through the platform.
All billing, receipts, packages, coupons, and offers are issued by, and remain the responsibility of, the Salon. ESA's role is limited to processing and displaying this information accurately through the POS terminal and Customer App as instructed by the Salon.
Complaints, refunds, cancellations, and service disputes must be raised with the Salon directly, using the Grievance Officer contact in Section 16. ESA is not responsible for resolving service-quality or billing disputes between you and the Salon, though it may assist the Salon in retrieving transaction records where needed.
Nothing in this clause limits your statutory rights as a consumer under the Consumer Protection Act, 2019 against the Salon as the actual service provider.
Our services and Customer App are intended for individuals aged 18 years or older. Services for minors may be availed with the consent and presence of a parent or legal guardian.
To use the Customer App or online booking, you may be required to provide your name, phone number, and email address. You are responsible for maintaining the confidentiality of your login credentials/OTP and for all activity under your account. Please notify us immediately of any unauthorised use.
Bookings made through the website or Customer App are subject to stylist and slot availability, and are confirmed only upon our acknowledgement (SMS/WhatsApp/app confirmation).
We reserve the right to reschedule or cancel an appointment due to unforeseen circumstances, and will make reasonable efforts to notify you and offer an alternative slot.
Cancellation/no-show policy: cancellations or rescheduling requests should be made reasonably in advance of the appointment time; late cancellations or repeated no-shows may attract a fee or require advance payment for future bookings, as communicated at the time of booking.
All prices are as displayed at the salon or on the website/app at the time of billing and are inclusive/exclusive of applicable taxes as indicated.
Payments may be made via cash, card, UPI, or other modes supported by our POS terminal.
Digital receipts for each transaction will be made available to you via the Customer App.
Refund policy: refunds, where applicable, are assessed on a case-by-case basis for services not rendered or verified billing errors, and are processed to the original payment method within a reasonable time.
Prepaid packages, once purchased, are subject to the validity period and terms communicated at the time of purchase and are generally non-transferable and non-refundable except as required by law or stated otherwise at purchase.
Loyalty points, coupons, and promotional offers have no cash value, cannot be exchanged for cash, and may be modified, suspended, or discontinued by us at any time with reasonable notice, except in respect of points/benefits already earned or validly issued.
We reserve the right to deny or withdraw a coupon/offer in case of suspected misuse, fraud, or violation of these Terms.
Provide accurate and current information when booking or registering.
Disclose any known allergies, skin/scalp conditions, or medical concerns relevant to the service being availed, so our stylists can take appropriate precautions.
Use the website and Customer App only for lawful purposes and not to transmit harmful, abusive, or fraudulent content.
Not attempt to interfere with, reverse-engineer, or misuse the website, POS system, or Customer App.
While we take reasonable care to deliver services professionally, individual results may vary based on hair/skin type and other factors. We are not liable for allergic reactions or adverse outcomes arising from undisclosed medical conditions, allergies, or prior treatments that were not communicated to us in advance.
All content on our website and Customer App, including our salon name, logo, images, and promotional material, is owned by us or licensed to us, and may not be copied, reproduced, or used without our prior written consent. The underlying software, design, and technology of the website, POS system, marketing module, and Customer App are owned by ESA and are licensed to us for use in operating our salon's digital services.
Our website and Customer App may use third-party services for payments (payment gateways), messaging (SMS/WhatsApp/email providers), and analytics. Your use of such third-party services may be subject to their own terms and privacy policies, over which we have limited control.
To the maximum extent permitted under applicable Indian law, the Salon's liability arising out of these Terms or your use of our services shall not exceed the amount paid by you for the specific service giving rise to the claim. The Salon shall not be liable for indirect, incidental, or consequential damages.
ESA / Elite Salon Alliance disclaims all liability for the performance, quality, safety, or outcome of any service rendered by the Salon, and for any dispute, loss, injury, or damage arising from your visit to, or service received at, the Salon's premises. ESA's role is limited to providing the underlying website, POS, marketing, and Customer App infrastructure, and — to the extent permitted by law — its liability, if any, is limited to proven technical failures directly caused by the platform (e.g., a billing record not syncing correctly), and in no event shall exceed the platform/subscription fees paid by the Salon for the affected feature in the preceding three months. ESA shall not be liable for any loss arising from the Salon's use, misuse, or mismanagement of the platform, or from the Salon's own service delivery, pricing, staffing, or business decisions.
You agree to indemnify and hold harmless the Salon and, separately, ESA/Elite Salon Alliance, from any claims, losses, or damages arising from your breach of these Terms, misuse of the Customer App, or violation of applicable law.
As between the Salon and ESA, the Salon agrees to indemnify and hold ESA harmless from any claims, losses, damages, regulatory action, or consumer disputes arising out of: (a) the actual beauty, grooming, or wellness services rendered by the Salon; (b) the accuracy of pricing, offers, coupons, and package terms the Salon publishes or issues through the platform; (c) the Salon's compliance with applicable law (including consumer protection, health and safety, employment, and tax law) in the conduct of its business; and (d) any misuse of customer personal data by the Salon or its staff outside the scope of the purposes described in the Privacy Policy. This allocation of responsibility is set out in the Salon's platform agreement with ESA and is referenced here for your transparency.
We may suspend or terminate your access to the Customer App or online booking if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused offers/loyalty benefits. You may stop using the Customer App and request account deletion at any time by contacting us.
In accordance with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000, any complaints regarding our services, billing, or the Customer App may be directed to our Grievance Officer:

We will acknowledge complaints within 48 hours and endeavour to resolve them within 30 days, as prescribed under applicable consumer protection rules.
These Terms are governed by the laws of India. Subject to the grievance redressal process above, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Delhi.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, government action, power or internet outages, or other events of force majeure.
We may revise these Terms from time to time. Continued use of our website, Customer App, or services after such changes constitutes your acceptance of the revised Terms. The "Last Updated" date above reflects the most recent revision.

This Privacy Policy applies to Elite Elegance Studio ("we", "us", "the Salon"), including our website, in-salon billing system, and any customer mobile/web application made available to you, which are powered by the ESA (Elite Salon Alliance) technology platform operated by Elite Salon Alliance ("ESA", "Platform Provider"). ESA processes personal data solely on our instructions, as our data processor, for the purposes described below.
This Privacy Policy explains how we collect, use, store, share, and protect personal data of clients, prospective clients, and website/app visitors ("you") when you visit our website, book an appointment, use our in-salon billing counter, or use the customer app to view receipts, packages, coupons, or offers.
This Policy is drafted to align with the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the Digital Personal Data Protection Rules, 2025, the Information Technology Act, 2000 and rules made thereunder, and the Consumer Protection (E-Commerce) Rules, 2020, as applicable to service providers operating in India.
For the purposes of the DPDP Act, Elite Elegance Studio is the Data Fiduciary — we determine the purpose and means of processing your personal data collected through this website, our billing counter, and the customer app. We are the party responsible and accountable to you, and to the Data Protection Board of India, for how your personal data is used.
ESA (operating as "Elite Salon Alliance" / "Elite Alliance"), as the technology platform provider, acts as our Data Processor only: it hosts our website, operates the point-of-sale (POS) terminal software, runs marketing/campaign tools on our behalf, and provides the customer app infrastructure, strictly under our instructions and this Policy. ESA does not sell your personal data, does not use it for its own independent marketing or commercial purposes, and does not determine why or how your data is processed — those decisions rest with us as the Salon.
Platform-only safeguard: ESA is a technology infrastructure provider to the Salon and is not itself responsible for the Salon's service delivery, pricing, offers, or its compliance with applicable law in operating its business. Any misuse of your personal data by the Salon or its staff outside the purposes stated in this Policy is the Salon's responsibility, not ESA's. ESA's obligations are limited to processing your data securely and only as instructed by the Salon, and to notifying the Salon promptly of any data breach on the platform so the Salon can meet its own notification duties under the DPDP Act.

We do not knowingly collect government ID numbers, financial account/card numbers, biometric data, or health records beyond general service-consultation notes described above.
To create and manage your booking and billing records, and issue digital receipts through the customer app.
To manage prepaid packages, membership tiers, loyalty points, coupons, and promotional offers.
To send appointment reminders, offers, and marketing communications via SMS, WhatsApp, email, or app notifications, where you have consented.
To improve service quality, staff training, and stylist allocation.
To operate, secure, and maintain the website, POS system, and customer app.
To comply with applicable tax, accounting, and legal record-keeping obligations.
To respond to your queries, feedback, or complaints.
We process your personal data on the basis of:
Your consent — for marketing communications, offers, and optional profile details (e.g., birthday, hair/skin preferences). Consent is collected through clear affirmative action (a checkbox or opt-in) and can be withdrawn at any time as described in Section 8.
Performance of a contract — for booking, billing, and package/loyalty administration necessary to provide services you have requested.
Legitimate/certain permitted uses recognised under the DPDP Act — such as maintaining transaction and billing records for accounting and legal compliance.
We do not sell your personal data. We share it only in the following circumstances:
With ESA (Data Processor), to the extent necessary to operate the website, POS, marketing module, and customer app.
With payment processors/payment gateways, solely to process billing transactions.
With SMS/WhatsApp/email service providers, solely to deliver reminders and offers you have opted into.
With regulators or law enforcement, where required under applicable Indian law.
With a successor entity, in the event of a merger, acquisition, or sale of the salon business, subject to equivalent privacy protections.
We do not share your data with other unaffiliated salons unless you have separately and explicitly opted into a cross-salon loyalty/alliance programme, in which case a supplementary notice describing that sharing will be provided to you at the time of opt-in.
Your data is stored on servers operated by ESA on our behalf, located in India. We require ESA to maintain reasonable security safeguards, including encryption in transit, access controls, and audit logging, consistent with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the DPDP Act's security obligations.
No method of transmission or storage is 100% secure. In the event of a personal data breach that is likely to affect you, we, as the Data Fiduciary, will notify you and the Data Protection Board of India as required under the DPDP Rules, 2025. ESA, as our Data Processor, is contractually required to notify us promptly of any breach affecting the platform so that we can meet this obligation; ESA's own liability for a breach is limited to breaches directly caused by its systems and is governed separately under our platform agreement with ESA.
Under the DPDP Act, you have the right to:
Access a summary of the personal data we hold about you and the processing activities undertaken.
Correct or update inaccurate or incomplete personal data.
Erase personal data that is no longer necessary for the purpose it was collected, subject to our legal retention obligations (see Section 9).
Withdraw consent for marketing communications and optional data processing at any time, as easily as you gave it. Withdrawal does not affect processing already carried out, or processing necessary for services already availed.
Nominate another individual to exercise these rights on your behalf in the event of death or incapacity.
Grievance redressal — raise a complaint with our Grievance Officer (Section 12) and, if unresolved, escalate to the Data Protection Board of India.
To exercise any of these rights, contact us using the details in Section 13. We will respond within the timelines prescribed under applicable law.
We retain billing and transaction records for the period required under applicable tax and accounting laws (typically 8 years). Marketing and profile data is retained until you withdraw consent or your account has been inactive for 24 months, after which it is deleted or anonymised, unless a longer retention period is required by law.
Our services are not directed at individuals under 18 years of age. Where a parent or guardian books a service for a minor, the parent/guardian's consent is treated as authorising the limited processing necessary to deliver that service, and we do not use a minor's data for behavioural monitoring, tracking, or targeted advertising.
